Late & Early Dropoffs
The daily rates are charged per broken 24 hours. If the vehicle is returned
after the time that was agreed in writing, we charge
$45
for every extra hour or part of an hour (but not more than the total daily
rate for every day late) and pass on any claims for compensation for damages
that may be asserted by the next renter or another person due to a late receipt
of the vehicle.
As a matter of principle, there is no agreement on part of the lessor to an automatic conversion into a rental relationship for an unlimited period of time if the renter continues to use the vehicle.
If the vehicle is returned before the expiration of the agreed rental period, the full rental price that was agreed is to be paid unless the vehicle can be rented to another party. In accordance with the current price list in force, the minimum rental period specified for certain travel periods are to be observed. A single lump-sum service charge is invoiced for every rental.

Conditions of Payment
The security deposit of
$1,724
must either be paid 21 days before the start of the rental period or deposited
free of charges upon receipt of the vehicle. In the event of reservations at
short notice (less than 21 days before the date of rental), the security deposit
and the expected rent are immediately due.
The security deposit is refunded if the vehicle is returned in a proper condition and after the final settlement of the rental contract by McRent HQ. Any extra costs incurred are offset against the security deposit when the vehicle is returned. In case the renter gets into default with his/her obligations, there shall be charged default interest in accordance with the applicable legal provisions.
Liability and Comprehensive Insurance Protection
The renter bears the costs of any damage that occurs during the rental period while using the vehicle in accordance with the contract up to
$1,724
per case of damage. The retention cannot be excluded.
To avoid increased costs caused by a determination of the costs of the damage, McRent shall, upon request, first present sample invoices for corresponding damage to the renter in case of a damage caused by accident. If the damage is caused by intent or gross negligence, especially if the renter was unable to drive due to the consumption of drugs or alcohol, the liability limitation does not apply. The same applies to any damage caused by not observing traffic sign 265 (maximum vehicle height on a road) in accordance with 41, sentence 2 # 6 of the StVO (Road Traffic Regulations - or corresponding regulations abroad). Despite the agreed limitation of liability, the renter is moreover fully liable for any damage caused by failure to observe the vehicle dimensions (vehicle height and width), by improper loading and unloading and by the load or by driving backwards without being directed.
In case the renter has unlawfully left the scene of the accident or violated his/her duties under item 8 of these terms and conditions, he/she is also fully liable, unless such violation had no effect on the case of damage. The renter is also liable to an unlimited amount for any damage that is caused by use of an authorized or unauthorized driver (item 9), for forbidden purposes (item 10), by the load, or by improper handling of the vehicle. Otherwise, legal liability shall apply.
The renter is liable for any damages claimed by a third party against him/her or against McRent that the renter has caused to a third party during the use of the object of rental. The renter is liable for all fees, levies, fines, and punishments that are imposed on the lessor in connection with the use of the vehicle unless they are caused by fault of the lessor.
Conduct in the Event of Accidents
After an accident, fire, damage caused by theft, or damage caused by game, the renter must inform the police and the headquarters of McRent in Munich without delay. The claims of opposing parties must not be admitted. In all cases of damage, the renter must immediately inform the headquarters of McRent in Munich or the rental station/depot by phone and submit a detailed written report, including a sketch, upon return of the vehicle at the latest.
The accident report must include the names and addresses of the persons involved and of the witnesses, if any, as well as the license numbers of the vehicles involved and must be signed by both parties. If the expected amount of the damage is higher than the amount of retention or if the vehicle is not fully roadworthy any more, the renter must immediately inform the lessor.
Authorised Drivers
The vehicle may only be driven by the renter himself/herself and by the drivers specified in the rental contract. The renter is obliged to record the names and addresses of all drivers who he/she allows to drive the vehicle, even if only for a short time. That information must be disclosed to the lessor if requested. The renter is liable for the acts of the respective driver in same way as for his/her own acts.
Forbidden Use
The renter is prohibited from using the vehicle in the following ways: for participation in motor sport events and vehicle tests; for the transport of inflammable, poisonous, or otherwise hazardous materials; for committing revenue offences and other offences, even if they are only punishable under the laws of the place of the offence; for subletting; for other kinds of utilization beyond the contractually agreed use, especially on areas that are not intended for driving.
The vehicle is to be handled in a careful and proper manner and must always be properly locked. The relevant instructions for use and technical rules as well as the maintenance periods must be observed. The renter undertakes to check regularly whether the vehicle is in a roadworthy condition.
Receipt and Return
The renter is obliged to participate in a comprehensive vehicle instruction at the handing-over station upon receipt of the vehicle. The lessor can refuse to hand over the vehicle until the instruction has been effected. Any resulting delays of receipt and costs are at the expense of the renter.
Before returning the vehicle, the renter must clean it on the inside. If the renter fails to do so, he/she is charged for the costs of the necessary cleaning (at least
$188 ). In case the lessor must clean the toilet in part or completely, cleaning
costs of up to
$259
are charged to the renter. The return of the vehicle is confirmed by the signature of the officer of the rental station on the return report. Without that signature, all damage to the vehicle is to be borne by the renter, especially if the vehicle is left at the station outside the business hours.
Substitute Vehicle
In case the reserved vehicle cannot be made available at the rental station, the lessor reserves the right to provide a vehicle that is comparable in size and equipment or bigger. That will not cause any additional rental costs for the renter. If a smaller vehicle is offered and accepted by the renter, the price difference of both vehicles is reimbursed. If the provision of a bigger vehicle causes higher ancillary costs, such as ferry charges and tolls or operating costs, such costs are to be borne by the renter.
Trips Abroad
It is possible to make trips abroad within Europe. Any trips to East European countries are subject to the lessor's prior approval. Trips to any war and unstable zones are forbidden.
Repairs
Repairs that become necessary to ensure the operating and traffic safety of the vehicle can be ordered by the renter up to an amount of
$259
without permission being required. Major repairs can only be ordered with the approval of McRent.
Repair costs are reimbursed by the McRent headquarters upon submission of the respective original receipts as well as of the parts replaced, unless the renter is liable for the damage (cf. item 6). In case the rental is not performed in accordance with the contract, the renter is entitled to redress, rent reduction or compensation for damage to the extent McRent is responsible for a defect in the vehicle. For getting redress, the customer must immediately notify the rental station of any defects found and allow a reasonable period for repair. In this connection, in particular specific conditions (infrastructure) of the respective country are to be taken into account; any delays that may occur are at the expense of the renter.
Storing and Passing on Personal Data
The renter agrees that McRent can store his/her personal data. McRent can pass these data on to third parties having a justified interest in them via the central warning ring if the information given upon renting is incorrect in essential points, or if the rented vehicle is not returned within 24 hours after the expiration of the rental period or extended rental period, if applicable, or if rent claims must be enforced in collection proceedings before a court or if cheques issued by the renter are not cashed.
In addition, the data can be passed on to all authorities responsible for the prosecution of infractions and offences if the renter actually acted dishonestly or there exist sufficient indication of such acting. For example, this is done in cases such as false information on the rental, submission of false personal documents or personal documents reported as missing, failure to return the vehicle, failure to notify a technical defect, violation of traffic regulations, etc.
